CCI secured an amendment to ensure the bill’s controlled burn notice requirements do not conflict with local notice procedures. An amendment was adopted to clarify that a controlled burn notice must go to appropriate local entity (such as a county sheriff, emergency management services, or other incident command), but still assumes that a local fire protection district is the appropriate local entity if the private property is located in the boundaries of a district that provides fire protection services. CCI is continuing to work with bill sponsors on this provision.

CCI sought an amendment to remove local enforcement responsibility and provide additional flexibility to building requirements. Because there would be no other enforcement mechanism, the House sponsor did not agree to remove the enforcement responsibility of local governments but an amendment was adopted to grant local governments the ability to issue waivers on the renovation threshold that triggers the bill’s requirements for existing buildings.

CCI has secured and will continue to secure amendments that will help the bill function better and extend its long term financial stability. Specifically, state revenue will play a key role in funding the basic cash assistance (BCA) increases resulting in the bill. Amendments also establish floors on both the county and state TANF reserves and specifies what will happen when/if the floors are hit. Additional amendments that CCI will secure in the senate include 1.) tasking the Works Allocation Committee to consider the new policies in HB 1259 when developing the formula that is used to distribute the $128m available in the county block grant and 2.) requiring the state to monitor and report out on what – if any – work support programs are negatively impacted by HB 1259 due to the shifting of dollars to BCA and away from work support programs.

CCI secured a series of amendments that will require the BHA to identify regional mechanisms to elevate grievance concerns to the state, continue to add counties as an entity for which the BHA must specifically engage, clarify that the accountability of RAEs will be overseen by the BHA, require the RAEs to invest in and expand programs that meet the Family First Prevention Services Act’s criteria.

CCI sought an amendment to clarify how the Office of Economic Development & International Trade (OEDIT) is to identify COVID-19 impacted areas of the state. An amendment was adopted to strike the reference to COVID impacted areas, and clarify that OEDIT can offer these “plus-up” incentives to certain areas of the state based on whether a community has limited economic opportunity, inadequate or poor-quality housing, a lack of housing inventory, and other factors.

Next, the working capital grants offered through the bill include minimum grant awards that is bumped up in coal transition communities, and an amendment was adopted to allow OEDIT to consult with industry experts and stakeholders to consider other areas that might be eligible for a higher grant minimum.

Lastly, an amendment was adopted to prioritize applicants if they are willing to dedicate a portion of their production for purchase by individuals or organizations that provide affordable homeownership opportunities, including opportunities for opportunities that are affordable in the long-term.

CCI explored an amendment with the bill’s sponsors that would require the state to backfill local government property tax revenue losses incurred by HB 1301. Ultimately, the bill was amended to include a repeal date in five years. So, the exemption under HB 1301 will be in place from January 2023 to January 2028.

Stakeholders negotiated and reached agreement on regional AMI caps to apply to these grant programs, with urban, rural, and rural resort regions defined by the Strategic Housing Working Group. Urban counties will have an 80% AMI cap for rental projects, 140% AMI for rural counties, and 170% for rural resort counties. A 140% AMI cap would be applied statewide for for-sale projects. All counties would be able to apply to DOH for re-classification into a different region, or for higher AMI caps based on demonstrated needs. Further, this agreement includes a 50/50 geographic split of funds through December 2023 (50% total to urban counties, 50% to rural/rural resort counties) given that a large majority of state affordable housing funds have historically gone to the metro area.

An amendment was adopted to increase the grant funding to local governments an additional $1 million (for adoption, enforcement and training costs), and to specify that funds can be used for grant writing assistance and to cover costs of aligning existing codes with the new mandated codes. An additional amendment was adopted to specify that beginning in 2023, local governments only need to adopt the required codes if/when they adopt or update their building codes. An amendment was also adopted to create an Advisory Board to develop the model codes instead of the Colorado Energy Office, and to require consultation with the Division of Housing and affordable housing experts in the stakeholder process that will take place for the development of the codes.

CCI sought an amendment to the bill to require commissioner approval of a salary increase for coroners in Category 2 counties, as commissioners are the fiduciaries of the county and have budgetary authority for all county elected offices.  An amendment was put on the bill that permits Category 2 counties to opt-out of the salary increase.

An amendment was adopted to get additional stakeholders from the water community to a neutral position. The amendment moves water-related criteria for fire suppression ponds to the bill as opposed to developing those requirements through rulemaking. The amendment also creates a rebuttable presumption to allow water rights holders to petition the State Engineer’s designation of a pond with sufficient evidence of injury.

CCI convened a bipartisan workgroup to think through requested amendments to this bill. The workgroup unanimously agreed that Section 4 on the phasing out of small, gas-powered equipment should be limited to incentives, and the prohibition on the sale of this equipment in nonattainment areas should be removed.  The bill was amended to remove Section 4 entirely, and limit the incentive program to a tax credit available for lawn equipment under 10 horsepower.
