CCI secured a series of amendments to maintain a focus on the child and reunification with their parents; some guardrails on relative/kin intervention, to avoid additional litigation; edits to the “reasonable efforts” standard for family finding; and other clarifications/consistency edits.

CCI supported a series of amendments that have been adopted that maintain a child focus and avoid extra burden on county departments.  

General Government

HB 1032 will allow people with disabilities to bypass state administrative requirements and file their
complaints direct in court in instances where businesses or governments have committed violations under
the Colorado Anti-Discrimination Act and Americans with Disabilities (ADA) Act. 

CCI is seeking amendments to cap emotional distress damages and to allow a court to award attorneys fees to the prevailing party, not just a prevailing plaintiff.

CCI is seeking amendments to a) ensure that bathroom renovations triggering bill requirements are SUBSTANTIAL in nature; b) verify that bill compliance requirements take place ONLY on the floor where renovations are taking place; and c) ideally the bill would only apply to new construction beginning in 2024.

After discussions with stakeholder, including CCI, the bill sponsor amended the bill to become a study.

Since this bill was postponed indefinitely, CCI is no longer seeking amendments to this bill. Despite this outcome, county feedback will continue to be solicited for fiscal notes on bills that have a direct county government impact.

CCI helped secure amendments that would allow more in-depth conversations about the use of TRAILS data in employment matters (among other issues) to occur in a task force setting over the 2023 & 2024 interim

CCI secured amendments that  require: Community Land Trusts and Nonprofit Affordable Homeownership Developers to adhere to the same application requirements as all other charitable entities must follow; 2.) add a claw back provision in case the land is sold off and the affordable homeownership property no longer meets the criteria for an exemption; and 3.) require that homes are sold to those who make the house their primary residence (helps avoid short term rental activity).

CCI is interested in cleanup amendments related to shortening the notification/offer/closing timeline, providing electronic notification, and clarifying a few phrases to improve the effectiveness of the bill and minimize any potential negative impact relative to the market. Most of these amendments have been secured. Discussions of shortening the timeline are ongoing.

CCI is seeking amendments to make the language defining “automated permitting and inspection software” more neutral, to ensure the grant is available to support other software add-ons compatible with local governments’ existing automated permitting technology.

CCI secured amendments that will ensure the regional subcommittees of the Behavioral Health Administrative Service Organizations (BHASOs) are created in a ‘bottom up’ type fashion and influenced by communities. CCI also secured amendment to  ensure that whomever lands the contract to serve as the BHSAO provides staff support to the regional subcommittees so that they can function as envisioned and elevate issues of concern to the BHASO and the BHA. 

CCI supports the study of inclusive language in emergencies, however feels the requirement to utilize should be dependent upon the results of the study and would like to see amended accordingly

CCI sought to strike a provision regarding the distance of a juvenile detention facility.

CCI is seeking amendments to ensure local government land use authority and the restraints local governments face in expediting land use applications are explicitly acknowledged in the bill language. CCI is also interested in exploring amendments to limit potential negative externalities resulting from the proposed increases in greenhouse gas reduction percentages.

Amendments protecting local land use authority throughout the bill have been secured. CCI is still interested in a discussing decommissioning and end-of-life costs of materials used to achieved reduced greenhouse gas emissions reduction targets.

CCI secured a series of amendments to create guardrails to ensure child permanency isn’t delayed.

CCI is seeking amendments to either exempt counties from the legislation or permit NDAs for settlement negotiations where both parties are willing to sign

Since this bill was postponed indefinitely, CCI is no longer seeking amendments that align the bill with the Colorado Department of Revenue’s private letter ruling guidance on the matter. Despite this outcome, CDOR will continue to require peer to peer car sharing companies to hold contractual agreements with car owners around the collecting of sales and rental taxes on each rental transaction.

Amendments increasing the amount that drainage and irrigation districts pay County Treasurers for the collection and remittance of the assessments levied by these districts have been secured. 

CCI has helped foster a good working relationship between county adult protective services experts and the Office of the Public Guardianship. Rather than pursing amendments on SB23-064, these two groups will continue to dialog to ensure the successful roll out of guardianship services throughout the state

CCI is seeking an amendment to move the backpay provision from six years to three years.

CCI is seeking amendments to clarify county authority to enact ordinances more stringent than those in the bill

Seeking amendments that clarify the definition of harassment and make changes to the employer liability and affirmative defense standards.

CCI was only able to secure 1 of 3 amendments commissioners sought. CCI was seeking amendments to 1.) Require the qualified electors of the DDA to vote on the continuation of the DDA OR allow all taxing entities (except the city) within a DDA to opt-in to any extensions beyond the current 20 year extension; 2.) Provide for better representation on the DDA board by allowing one individual from the county, the  school(s) and the special district(s) to be included on the DDA board; and 3.) Remove the portion of SB 175 that gives the DDA bonding authority (this power should remain with the elected council members and mayor of the city). Amendment #3 was secured. CCI also secured an amendment that will give counties and schools a seat on the DDA board after the DDA is 50 years old.
